TERMS FOR PROMOTIONS, INSTANT PRIZES AND OFFERS AND PRIVACY NOTICE
I. GENERAL PROVISIONS
These terms and this privacy notice set out how promotions, instant prize campaigns, discounts, special offers and other marketing initiatives using the MB “Mohub” system are carried out.
MB “Mohub”, company code 307022080, email address [email protected], administers the technical system that enables participants to take part in a promotion, receive an offer, verify their email address, use an offer and, where applicable, receive notifications related to that offer.
The specific conditions of a promotion, prize, discount or offer are determined by the company at which you participated in the promotion or whose offer you chose to receive. This company is hereinafter referred to as the Promotion Partner.
By participating in a promotion, registering to receive an offer, providing your email address or using an offer, you confirm that you have read these terms and agree to comply with them.
II. PROMOTION PARTNER AND RESPONSIBILITY
The Promotion Partner is responsible for the content, value, terms of provision, validity period and actual fulfilment of the specific prize, discount, offer or other benefit.
MB “Mohub” is not responsible for the Promotion Partner’s goods, services, quality of service, the economic value of the offer, its application at the checkout or any other actions of the Promotion Partner, except where this is directly related to the operation of the technical system administered by MB “Mohub”.
If additional terms are specified on the page of a specific promotion, they apply together with these terms. In the event of any conflict between the general terms and the terms of a specific promotion, the terms of the specific promotion shall prevail.
III. PARTICIPATION IN THE PROMOTION
A promotion may be entered by persons who scan a QR code, complete a survey, submit answers, choose an offer, provide an email address or perform other actions specified in the relevant promotion.
Participation in the promotion is voluntary.
In order to receive a specific offer by email, it may be necessary to provide an email address and, where applicable, verify it using a code received by email.
One person, email address, device or visit may be limited to one participation or one offer within the period specified in the terms of the relevant promotion.
MB “Mohub” and the Promotion Partner have the right to limit repeated registrations, cancel clearly unfair participation, reject registrations created by technical means or refuse to provide an offer if abuse, an attempt to bypass the rules, submission of false data or other unfair actions are identified.
IV. INSTANT PRIZES AND OFFERS
During the promotion, a participant may be provided with an instant prize, special offer, discount, gift, coupon or another benefit determined by the Promotion Partner.
The value, quantity, validity period, terms of use and other restrictions of a specific prize or offer are indicated on the page of the relevant promotion, in the email, in the offer window or in the Promotion Partner’s communication.
An offer may be linked to a specific email address, code, promotion number, device, visit, location or another technical identifier.
An offer may not be exchanged for cash, transferred to another person or combined with other promotions, discounts or offers, unless otherwise specified in the terms of the relevant promotion.
If an offer is not used within the specified validity period, it expires and is not compensated.
MB “Mohub” and the Promotion Partner reserve the right to change, suspend or terminate a promotion if this is necessary due to technical errors, abuse, force majeure circumstances, legal requirements, changes in the Promotion Partner’s operations or other objective reasons.
V. EMAILS AND NOTIFICATIONS
If you provide your email address, it is used to send the specific Promotion Partner’s offer, verify your email address, administer the validity of the offer, check the use of the offer and, if you have given your consent, send a reminder about an offer that is still valid.
Emails related to a specific offer selected by you are sent not as a general MB “Mohub” newsletter subscription, but as part of the administration of a specific promotion and a specific Promotion Partner’s offer.
Other marketing offers from the Promotion Partner or MB “Mohub” may be sent only if you have given separate consent for this.

VI. PERSONAL DATA PROCESSED
For the purposes of administering the promotion and the offer, the following personal data may be processed:
• email address;
• email verification status;
• the offer selected by you or assigned to you;
• offer code, promotion number or another technical identifier;
• registration date and time;
• start and end date of the offer validity period;
• offer usage status;
• version of consents, terms and privacy notice;
• survey answers, if they are technologically linked to the offer registration;
• identifier of the location, promotion, restaurant, shop or other Promotion Partner unit;
• technical information necessary to ensure system operation, security, error diagnostics and prevention of abuse.
MB “Mohub” does not collect more data than is necessary for the specific promotion, offer, system operation, security, accounting and protection of legitimate interests.
VII. PURPOSES AND LEGAL BASES OF DATA PROCESSING
Personal data may be processed for the following purposes:

To administer registration for the promotion, verify the email address, provide the specific Promotion Partner’s offer and control the validity of the offer.
Legal basis – actions carried out at your request when you register to receive an offer.

To send the specific Promotion Partner’s offer, code, confirmation or information related to the offer to the email address provided by you.
Legal basis – your request to receive a specific offer and, where applicable, your consent.

To send a reminder about a specific offer that is still valid.

To send other marketing offers from the Promotion Partner or MB “Mohub”.
Legal basis – your separate consent.

To account for the use of the offer, analyse promotion results, prepare reports for the Promotion Partner and assess service quality.
Legal basis – legitimate interest in assessing the effectiveness of promotions, substantiating the provision of offers and improving the service.

To protect against abuse, repeated registrations, fraud, technical errors, unlawful use of offers and to ensure system security.
Legal basis – legitimate interest in ensuring fair, secure and proper administration of promotions.

To examine disputes, bring claims, defend against complaints, prove consents and fulfil legal obligations.
Legal basis – legitimate interest and, where applicable, legal requirements.
VIII. DATA RETENTION PERIODS
Personal data is retained for as long as necessary to administer the specific promotion, offer, discount, instant prize or other marketing initiative, verify the use of the offer, prevent abuse, account for results and defend legitimate interests.
The specific data retention period depends on the terms of the relevant promotion, the validity period of the offer, the period for claiming the prize or offer, the campaign parameters set by the Promotion Partner, the need to prevent abuse, accounting needs and the risk of possible disputes or claims.
The email address, offer code, offer validity information and offer usage status may be retained for the entire validity period of the offer and for up to 24 months after the end of the offer validity period, if this is necessary for offer administration, accounting for offer use, reports to the Promotion Partner, dispute prevention, abuse prevention or protection of legitimate interests.
If the terms of a specific promotion provide for a longer offer validity period, prize collection period, accounting period, warranty period, complaint handling period or another objectively justified period, the data may be retained for longer, but no longer than necessary to achieve the relevant purposes.
Data related to proof of consent, the version of the terms, the fact of registration, provision of the offer, use of the offer, system security and prevention of abuse may be retained for up to 36 months from registration, use of the offer or the end of the offer validity period, depending on which date is later.
If data is required for a dispute, complaint, investigation, debt, legal claim, accounting or fulfilment of a legal obligation, it may be retained until the end of such dispute, complaint, investigation, claim or obligation and for an additional period to the extent permitted by applicable law.
Direct marketing consents and related proof information may be retained for up to 5 years from the date of consent or until the consent is withdrawn, whichever occurs earlier, unless longer retention is necessary to prove consent, resolve a dispute or comply with legal requirements.
After the established retention period expires, the email address is deleted from active systems or the data is anonymised, except where longer retention is necessary for legitimate purposes.
Data may remain in backup copies for a limited technical period until the backup copies are automatically overwritten or destroyed in accordance with the technical procedures applied by MB “Mohub”.
IX. USE OF HASH VALUES AND PSEUDONYMOUS DATA
In order to ensure system operation, protection against repeated registrations, prevention of abuse and fraud, control of offer use and exercise of data subject rights, MB “Mohub” may store a cryptographic hash value of the email address or other pseudonymous technical identifiers.
The hash value and other pseudonymous technical identifiers are used only for technical, security, offer administration, abuse prevention and legitimate interest protection purposes.
The hash value is not used to send marketing communications and is not used to restore the email address.
Pseudonymous technical data may be retained for longer than the email address if this is necessary for system security, control of repeated registrations, abuse prevention, statistics or dispute prevention.
X. SYSTEM LOGS
System logs may store technical information required for system operation, security, error diagnostics, abuse prevention and incident investigation.
Email addresses are generally not stored in technical logs, except where this is necessary to investigate a specific error, incident, case of abuse or security event.
Technical logs are retained for as long as necessary to ensure system security, stability, error analysis and incident prevention.
XI. DATA RECIPIENTS
Personal data may be transferred only to the extent necessary to administer the promotion, provide the offer, maintain the system, ensure security or defend legitimate interests.
Data may be transferred to:
• the Promotion Partner whose offer you chose to receive or use;
• email delivery service providers;
• providers of server, hosting, data storage and technical infrastructure services;
• providers of system maintenance, programming, error diagnostics and security services;
• legal, audit, accounting or other professional service providers, where this is necessary to implement legitimate interests or legal obligations;
• public authorities, where required by applicable law.
Service providers process personal data only to the extent necessary to provide their services and must apply appropriate technical and organisational security measures.
XII. TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA
If service providers or their technical infrastructure are located outside the European Economic Area, personal data may be transferred only by applying safeguards provided for by law, including the standard contractual clauses approved by the European Commission or another lawful transfer mechanism.
XIII. DATA SUBJECT RIGHTS
You have the right to:
• access your personal data;
• request correction of inaccurate or incomplete data;
• request deletion of data;
• restrict data processing;
• object to data processing where it is based on legitimate interest;
• withdraw consent where data processing is based on consent;
• receive data concerning you where the right to data portability applies;
• lodge a complaint with the State Data Protection Inspectorate.

Withdrawal of consent does not affect the lawfulness of data processing carried out before the withdrawal of consent.
In certain cases, a request to delete data may not be fulfilled immediately or may be fulfilled only in part if the data is necessary for administration of the promotion, accounting for offer use, prevention of abuse, examination of disputes, compliance with legal requirements or protection of legitimate interests.
XIV. CHANGE, SUSPENSION OR TERMINATION OF THE PROMOTION
MB “Mohub” and the Promotion Partner have the right to change, suspend or terminate the promotion at any time if this is necessary due to technical errors, system malfunctions, abuse, incorrectly stated terms, legal requirements, circumstances relating to the Promotion Partner’s operations or other objective reasons.
If, due to a technical error, an incorrect offer, incorrect prize information, incorrect validity period or other incorrect information was shown to a participant, MB “Mohub” and the Promotion Partner have the right to correct the error and apply the actual terms of the relevant promotion.
XV. UPDATE OF THE TERMS
MB “Mohub” has the right to update these terms and this privacy notice.
The latest version of the terms is published on the relevant promotion, offer or system page.
The updated version of the terms applies from the date of its publication, unless specifically stated otherwise.
